1. Conclusion of the travel contract
By booking, you are making a binding offer to conclude a travel contract on the basis of the service descriptions and prices stated in our catalogue or on our website and are bound by your offer for 14 calendar days. The booking must be made in writing (by fax, email, post or online). The individual making the booking undertakes to be responsible for the contractual obligations being fulfilled by persons whom the individual has specified in their booking as well as for the individual’s own contractual obligations. The travel contract is concluded upon issue of our booking confirmation (an email confirmation is also valid for this purpose).
2. Payment of the package price
After you have received the booking confirmation/invoice, a deposit of 20% of the total package price per person (+ costs for insurance and/or Komoot) is due for payment immediately. The balance is payable no earlier than 20 days before the start of the tour so that the travel documents can be sent out step by step.
Travel insolvency insurance in accordance with the EU Package Travel Regulation, (EU) 2015/2302
In the event of insolvency, the package tours organised by Austria Radreisen (payments already made for travel arrangements that were no longer provided and necessary expenses for the return journey) are covered by insolvency insurance held with Raiffeisenbank Region Schärding, Oberer Stadtplatz 42–43, 4780 Schärding, Austria. In the event of insolvency, all claims must be filed with the liquidator, Europäische Reiseversicherung AG, Kratochwjlestraße 4, 1220 Vienna, Austria, tel.: +43 1 317 25 00; fax: +43 1 319 9367.

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights applying to packages. The package price (in euros) is per person based on occupancy of a double room. Solo travellers have the option of booking a single room for an additional charge. However, due to the limited number of single rooms in some hotels, solo travellers must be prepared to accept simpler rooms if necessary. The scope of contractual services is determined by the service descriptions for the relevant tour in the Austria Radreisen catalogue valid for the travel period in question. The stated stopover locations are the most frequently and principally visited stopover locations. In occasion, your consent to switch to alternative locations in the immediate vicinity will be assumed without deduction.
4. Withdrawal from the trip or altering the booking
If you withdraw from the booked trip, you must send us a cancellation in writing immediately. We will charge the following cancellation costs:
up to 28 days before departure: 20% of the total package price per person
between 27 and 14 days before departure: 30% of the total package price per person
between 13 and 8 days before departure: 50% of the total package price per person
between 7 and 4 days before departure: 70% of the total package price per person
within 3 days or in the event of a no-show: 90% of the total package price per person
If the trip is curtailed, you will not be entitled to a pro rata refund. The date of arrival counts as the start of the trip. In the event of alterations (change of travel date/category/room type/board) up to the 28th day before the start of the trip, we will charge an administration/alteration fee of €55.00 per booking. Later alterations to bookings, insofar as they are possible, can only be made by withdrawing from the travel contract under the stated terms and simultaneously making a new booking. For non-original tours, separate cancellation or alteration fees may apply in some cases. Please contact us for more information about the conditions applicable to your chosen cycle tour.
5. Changes to the package price
The operator reserves the right to increase the package price confirmed with the booking for unforeseeable reasons beyond the operator’s control if the travel date is more than 2 months later than the date on which the contract was concluded. Such reasons are limited to changes in transport costs, such as increases in fuel costs or increases in embarkation and disembarkation fees at ports. The operator may increase the package price in accordance with the following calculation:
a. In the event of an increase related to the cabin berth, the traveller may be required to pay the difference.
b. In other cases, the additional transport costs demanded by the carrier per mode of transport will be divided by the number of cabin berths in the agreed mode of transport. The traveller may be required to pay the resulting increase for their cabin berth. We are under obligation to inform you without undue delay, but no later than 21 days before the agreed date of arrival, of any intended legally permissible price increase. No price increases are permitted after this date. If price increases exceed 8% of the total package price, the traveller is entitled to withdraw from the travel contract without incurring any fees. You must assert this right against us without undue delay after receipt of the change notification. In such cases, we will refund any payments that have already been made to us. There will be no entitlement to further claims. Please note that the package tours are subject to available hotel capacity. If accommodation in the booked category is not available and a higher or lower category has to be booked instead, we reserve the right to charge a corresponding surcharge or to apply a discount.
In line with our duty to exercise all due care and diligence as a business, we are liable for the correctness of the description of all specified travel services at the time the brochure is printed, for the proper selection and arrangement of bookings with the service providers (hotels, transport companies, etc.) and for the conscientious preparation and execution of the tour. We cannot be held responsible for any visits specified in the itinerary that are not possible for reasons beyond our control (e.g. renovations, closures, building work).
You participate in the tours at your own risk. Each participant has sole responsibility for ensuring that he or she is in a fit state of health to cope with the demands of the booked trip. You must be able to control the bike in traffic, on farm tracks and in wet conditions. Each tour participant also has sole responsibility for adhering to the road traffic regulations. This tour is not suitable for people with limited mobility. The conditions of carriage of the transport companies used will apply. We will only be liable for claims resulting from loss of or damage to your luggage during luggage transport if this is the fault of our legal representatives, proxies or vicarious agents and is reported to us as soon as it occurs. We generally exclude liability for damage to items of luggage whose handles, straps or wheels break during proper carrying or pulling as a result of wear and tear or overloading. The hotelier is liable for damage to luggage that occurs after it has been brought into the hotel.
Transport of participants’ own bicycles – both during a tour and during transfers – may only take place at their own risk. The mounting settings on the trailer are adjusted to the tour operator’s bicycles, which means that slight damage, in particular damage to paintwork, may occur to third-party bicycles. No liability can therefore be accepted for slight damage that occurs during transport.
Our total liability – irrespective of the legal grounds – is limited to the sum of three times the package price, insofar as the damage was caused by us neither intentionally nor through gross negligence or insofar as we are solely responsible due to the fault of a service provider selected by us. As a general rule, unused services will not be reimbursed.
Each customer is responsible for their compliance with all passport, visa, customs and health regulations. Minors may only participate when accompanied by a parent or legal guardian. If a tour has to be cancelled for reasons beyond our control (force majeure, strikes, etc.) or, in the case of boat tours, in the event of extremely high or low water or engine failure, the package price that has already been paid will be refunded. There will be no entitlement to further claims. We reserve the right to cancel a tour no later than 21 days before the start of the tour if the required minimum number of participants is not reached. Where this is the case, we will inform you immediately and refund any payments made. There will be no entitlement to further claims. If, contrary to expectations, you have cause to complain, please bring this to the attention of the local representative (see travel documents) or us without undue delay. Furthermore, it is a prerequisite for the assertion of any claims against us that they are submitted to us in writing no later than one month after the contractually agreed end of the tour. Our written confirmation is required for verbal collateral agreements to be valid.
We reserve the right to make changes to the services and prices as well as to correct mistakes, printing errors and calculation errors. The place of jurisdiction is the operator’s registered office.
Austria Radreisen may act both as a tour operator and as an agent for the tours offered. In the event that it acts as an agent, the travel contract is concluded with the local tour operator.
